The
Bode City Council met in regular session Monday March 3, 2025 at 5:30PM in the
council chambers. Council members Hasfjord, Miller, Fulwider, and Tepner were
present, absent McKenna. Also, present Jim Fischer. Mayor Peterson called the
meeting to order, a motion was made by Miller, second by Hasfjord to approve
the agenda as posted. All ayes, motion carried. A
motion was made by Tepner, second by Miller, to approve the minutes of the
February 3 council meeting as published. All ayes,
motion carried.
This
being the time and place specified for holding the public hearing and taking action on the proposal to enter into a Sewer Revenue
Loan and Disbursement Agreement, the City Clerk announced that no written
objections had been placed on file.  Whereupon, Mayor Peterson called for any written or oral
objections, and there being none, the Mayor declared the public hearing closed.
After
due consideration and discussion, Council Member Miller introduced the
following resolution and moved its adoption, seconded by Council Member
Tepner.  Mayor Peterson put the question
upon the adoption of said resolution, and the roll being called, the following
Council Members voted:
Ayes: Miller, Hasfjord, Tepner, and Fulwider
Nays: None .
Whereupon, the Mayor declared the resolution duly adopted, as follows:
Resolution
2025-04 “ A Resolution taking additional action on proposal to enter into a
Sewer Revenue Loan and Disbursement agreement 
WHEREAS, the City of Bode (the “City”), in Humboldt County, State of Iowa, did heretofore establish a Municipal Sanitary Sewer System (the “Utility”) in and for the City which has continuously supplied sanitary sewer service in and to the City and its inhabitants since its establishment; and
WHEREAS, the management and control of the Utility are vested in the City Council (the “Council”) and no board of trustees exists for this purpose; and
WHEREAS, the City has heretofore proposed to contract indebtedness and enter into a certain Sewer Revenue Loan and Disbursement Agreement (the “Agreement”) and to borrow money thereunder in a principal amount not to exceed $975,000, pursuant to the provisions of Section 384.24A of the Code of Iowa, for the purpose of paying the cost, to that extent, of planning, designing and constructing improvements and extensions to the Utility, and has published notice of the proposed action and has held a hearing thereon on March 3, 2025.

The City’s
attorney had prepared action on two nuisance properties that the council
reviewed. Following review it was agreed to follow his
procedures on both properties. The city was directed to continue to take photos
during this process.
This being the time and place for the
Public Hearing on Sewer rate increase. There were no residents present at this
hearing. Following discussion, a motion was made by Fulwider, second by Tepner
to approve the changes in Ordinance # 2025-1 Sewer rates and waive the
second and third reading and adopt the Ordinances as follows:
            Utility Billing Charges, Sewer
Rates, section 6-5-10 of the city to adopt Ordinance # 2025-1:Sewer Rates: 
SEWER
RATES: Sewer usage shall be billed quarterly (And is based on water usage).
Sewer
shall be furnished at the following rates per property services within the city
limits:
WATER
RATES: The first 1,000 gallons 55.00/quarterly quarter. All over 1,000 will be
billed 2.00 per 1,000.
SEWER
RATES: 100 % of
water rates
The City will charge $50 per account each quarter for debt
reduction starting July 1, 2025. This fee will increase to $135 per quarter on
July 1, 2027.
            Ayes: Miller, Hasfjord, Tepner, and Fulwider
            Nays: None
This being the time and place for the
Public Hearing on Water rate increase. There were no residents present at this
hearing. Following discussion, a motion was made by Tepner, second by Miller to
approve the changes in Ordinance # 2025-2 Water rates and waive the second and third reading and adopt the Ordinances
as follows:
Utility

WATER
RATES: Water usage shall be billed quarterly. Water shall be furnished at the
following rates per property services within the city limits:
            The first 1,000 gallons                        55.00/quarterly
            All over 1,000 gallons             2.00 per 1,000 gallons
Sewer
Rates: 100 % water
The City will increase the usage rate of water by 2% annually
starting on July 1, 2028
            Ayes: Miller, Hasfjord, Tepner, and Fulwider
            Nays: None
 Spring
Clean-up Day has been set for May 22rd from
Noon-8pm. Details will be provided in the April Newsletter. 
A motion was made by Miller, second by
Fulwider to approve the Proposed Property Tax Max Levy for fiscal year July 1,
2025-June 30, 2026 and set public hearing as Monday April
7th at 5:30PM in the council chambers. All ayes,
motion carried.
